Based on applicable data protection law, you have the right to access, rectification, deletion, restriction, objection and data portability under the conditions stipulated in such law.


If the processing of your personal data is based on your consent, you can withdraw your consent for the processing of your personal data at any time. The data will then be deleted immediately provided that its further retention is not prescribed by law or needed for billing or accounting purposes or as soon as these purposes are fulfilled.


You have the right to object to the processing of your personal data that we process based on our legitimate interests. We shall no longer process your personal data for these purposes, unless our legitimate grounds for processing override your interests, rights, and freedoms.


If you object to the processing your personal data for direct marketing purposes, your personal data shall no longer be processed for such purposes.

WHAT IS CONSIDERED PERSONAL DATA?

Personal data is any information that relates directly or indirectly to a natural person and that can be used to find out your identity. This includes such information as your name, address, telephone number, but can also be your location or the IP number of your computer or other device.


The provisions below apply to each user of our website and to each data subject of whom we process personal data.

WHAT PERSONAL DATA DO WE PROCESS, FOR WHAT PURPOSE AND ON WHAT LEGAL BASIS?

  • if we have a legal basis to do so.

  • Contract – A contract with you that we are required to perform or to take steps to perform before entering into a contract with you.

  • Legitimate interest – A legitimate interest that we as an organization pursue, including also to optimize our services.

  • Legal obligation – A legal obligation that we must comply with.

Below we explain which categories of personal data we process and for what purposes we process your personal data.

WHAT PERSONAL DATA DO WE PROCESS AND FOR WHAT PURPOSE?

COOKIES

FINANCIAL TRANSACTIONS

EMCC Switzerland is registered as a non-profit organisation (association, Verein) in Switzerland. According to Swiss law we are required to keep financial records showing any payments you make to us for ten years, e.g. your membership, buying a book, booking a conference place, etc.


If you make a payment to another EMCC country or regional organisation then you must contact that organisation regarding that financial transaction.

MEMBERSHIP

When you apply for membership with EMCC Switzerland we require you to let us have your name, address, country, city, telephone number, and email address. You can optionally also provide further details, e.g. your website.


These details are only kept for the purposes of maintaining your membership. You are free to withdraw this information at any time online by making changes in your membership record and we will immediately remove it from our database or by contacting us directly as specified in this Privacy Policy. Please be informed that, by removing essential personal data, you will be cancelling your membership of EMCC Switzerland.

FIND A MENTOR/COACH/SUPERVISOR

If you are a member of EMCC Switzerland you automatically have a ‘Find a Mentor/Coach/Supervisor’ profile on the EMCC Global website which is publicly searchable. The profile is created using your membership data. You can add information to this profile including a CV, areas of expertise (your profile will automatically be set to ‘general’), the languages you speak, which countries you work in, links to your website etc.


You can remove your publicly listed profile from our website at any time by amending the ‘Find a Mentor/Coach/Supervisor’ part of your membership record. Changes in this area do not affect your membership record.

ACCREDITATION

We receive from EMCC Global information on your accreditation with them (in the form of reports). We use such information to align your accreditation with your membership with EMCC Switzerland.


Please consult EMCC Global’s privacy policy for details on your accreditation record kept by them. Further, you can contact them to view such record and to request them to remove this data.

EVENTS

We adhere to the following general principles: When you register for one of our events, webinars, or any other type of event we keep a record of your personal data before, during, and after your registration. Before and during the event the data is used to ensure that you get the most out of your event. After the event we keep your data so that we can let you know (e.g. via email) of other events that you might be interested in.


At the event, you may be asked for your consent to have your e-mail address shared with the other attendees to keep in touch after the event. You are free to provide or refuse your consent. Further, you may be asked to sign a separate privacy consent form for each event.

OTHER

We may also process the above categories of personal data to protect our legitimate interests or those of third parties, including fraud detection, if you compromise or threaten to compromise the security of our systems or those of third parties. In addition, we may process the above categories of personal data in the context of business transactions (e.g. an acquisition). For this, we rely on our legitimate interest.


We may be legally obliged to process or disclose the above categories of personal data to a competent (e.g. judicial) authority or their representatives as a result of their reasonable request or to the police on our own initiative if we have reasonable grounds to believe that your use of our products or services would constitute a criminal offense. We may also be legally obliged to process the above personal data in order to comply with any other legal obligation incumbent on us, such as accounting obligations.

FROM WHOM DO WE RECEIVE YOUR PERSONAL DATA?

In most cases, we receive your personal data directly from you. In other cases, we receive your personal data from EMCC Global and from our partners, such as organizers of our events or other partners. If we act as a processor for our partner(s), we will only process your personal data in accordance with the instructions of our partner(s).

HOW DO WE SECURE YOUR PERSONAL DATA?

The security of the personal data we process is important to us. We have implemented and maintain appropriate technical and organizational measures to protect your personal data against unauthorized access or theft, as well as against accidental loss, manipulation or destruction. Access to your personal data occurs only on a need-to-know basis and is subject to appropriate confidentiality obligations.


We save the information you provide on specially protected servers. These servers can be accessed only by a limited number of selected persons.

WITH WHOM DO WE SHARE YOUR PERSONAL DATA?

For the purposes of managing your membership with EMCC Switzerland and since all members of EMCC Switzerland are automatically members of EMCC Global, we share your membership details with EMCC Global.


Further, we may share your personal data with third parties to process your personal data for the purposes described above, for example:

  • To provide you with our products, services and website (such as a hosting provider); or

  • To provide you with our marketing emails (such as a marketing company); or

  • To fulfill our contractual obligations towards our partners.

These third parties may only process your personal data in accordance with our instructions if they act as a processor. We also ensure that all such third parties are selected with due care and are committed to maintaining the security and integrity of your personal data (in particular by entering into a corresponding data processing agreement with such third parties if they act as a processor).


We may be required by law to share your personal data with competent authorities or their agents, judicial authorities, government agencies or bodies, including competent data protection authorities, in order to comply with a legal obligation as set out above.


We do not share your personal data in any identifiable way with third parties other than those mentioned above without your consent. However, we may send anonymised and/or aggregated data to other third parties who may use this data to improve our services and for marketing purposes. We never sell your data to third parties.

WHERE DO WE PROCESS YOUR PERSONAL DATA?

In order to process your personal data for the purposes set out above, we may transfer your personal data to third parties who process on our behalf outside Switzerland and the EU/EEA. Any entity outside Switzerland and the EU/EEA that processes your personal data is required to adhere to adequate safeguards in relation to the processing of your personal data. Such safeguards may result from:

  • an adequacy decision by the Swiss government or the European Commission (depending on the relevant applicable data protection law); or

  • the conclusion of Standard Contractual Clauses.

We may transfer anonymised and/or aggregated data to third parties outside Switzerland and the EU/EEA. If such a transfer occurs, we will ensure that safeguards are in place to ensure the security and integrity of your data and any rights relating to your personal data that you might enjoy under applicable law.

MAKING A COMPLAINT
